- Identification of Landlord, Tenant and property
- Amount in figures and words, date and means of payment
- Discharge statement signed by the Landlord
- Note on the two-month cap and the tax obligation
When to use the security deposit receipt
Whenever you receive the deposit, above all in cash, where there is no bank record. It is a simple receipt: it does not regulate the return or the deductions, which belong in the lease.
Receipt or deposit declaration?
The receipt proves the handover. The security deposit declaration adds the purpose, the return period, the permitted deductions and a final settlement statement.
Legal basis
The parties may secure their obligations up to the amount corresponding to two months' rent (article 1076(2) of the Civil Code). The law sets no general deadline for returning the deposit: what was agreed applies.
Mistakes to avoid
- Receiving the deposit with no receipt or proof of payment.
- Charging more than two months' rent as a deposit.
- Treating the deposit as rent paid.
Frequently asked questions
Must the landlord issue a receipt for the deposit?
Lease law sets no specific receipt for the deposit, but without a document the payment is hard to prove. Depending on the landlord's tax status, it may also have to appear on the electronic rent receipt.
What is the maximum deposit?
An amount equal to two months' rent (article 1076(2) of the Civil Code). For more security, use a guarantor, a bank guarantee or rent insurance.
Does the tenant have to sign the deposit receipt?
No: the landlord is the one declaring receipt, so the landlord signs. Give one copy to the tenant and keep another.
When is the deposit returned?
After the lease ends and the property is handed back, within the period agreed in the lease. There is no general statutory deadline.
