Getting the security deposit back is the last step of a lease, and the most disputed. This template brings together the tenant's letter to the landlord, with a deadline, an IBAN and a request to justify any deductions, and a settlement statement to close the accounts in writing. Download it free in PDF and Word, or record the deposit and its return in the Aluseg app.
- Identification of the parties, the lease, its end and the key handover
- Return request with a deadline (contractual or set in the letter) and IBAN
- Demand for an itemised statement and documents for any deduction
- Reminder that wear from prudent use is not deductible (art. 1043 Civil Code)
- Settlement statement with balance and both parties' signatures
When to ask for the deposit back
After the lease ends and you have handed back the property and the keys. Attach, if you have them, the key handover record or the check-out inspection record.
What is the deadline to return the deposit?
The law sets no general deadline: the period agreed in the lease applies. If there is none, the letter sets a reasonable period counted from its receipt.
What the landlord can deduct
Rent and charges owed and the repair of damage attributable to the tenant, with a supporting document. The landlord cannot deduct wear inherent in prudent use (article 1043 of the Civil Code).
Mistakes to avoid
- Handing over the keys with no written record.
- Accepting deductions with no statement or invoices.
- Sending the request with no proof of the date.
Frequently asked questions
How long does the landlord have to return the deposit?
There is no general statutory deadline: the period in the lease applies. If the lease is silent, set a reasonable period in writing, counted from receipt of the request.
Can the landlord keep the deposit for repainting or wear?
Not for wear inherent in prudent use (article 1043 of the Civil Code). Specific damage attributable to the tenant may be deducted, with a supporting document.
How do I ask for the deposit back?
In writing, stating the amount, deadline and IBAN, and asking for an itemised statement of any deductions. A registered letter with acknowledgement of receipt or an email with read receipt proves the date.
What if the landlord does not return the deposit?
Follow up in writing and keep all proofs. If the refusal continues, you may use the legal means of dispute resolution.
