In a market where a listing receives dozens of applications in a few hours, those who arrive at the viewing with their application file ready have a head start. Between applicants with similar incomes, the landlord almost always chooses the one who can prove what they claim — on the very same day, without the ‘I will send it tomorrow’ excuse.

The essential checklist: the necessary documents to rent a house

Let’s start with the inconvenient part: there is no official list — we will get back to that later. However, there is a standard practice: as a rule, these are the documents that landlords and real estate agencies ask of an applicant.

The number of payslips is negotiable: three is the most frequent request, not a rule. It is useful to know the criteria by which they will be evaluated — the effort rate, the weight of the rent on the household’s net income.

The Portuguese convention is around one third (the most used ranges go from 30% to 35%), but it is not a legal limit: no law sets a maximum effort rate for renting — it is a selection criterion, not a prohibition. Documents by situation

The checklist above is the common core; what distinguishes a solid application is the part that corresponds to your situation.

Employee

Payslips, employment contract, and income tax return with the tax assessment notice. Two details make a difference: the type of contract — a permanent contract is seen as stability and carries more weight than the salary amount — and the employer’s declaration, a short document from human resources confirming the role, seniority, and remuneration.

It is frequently described as decisive, because it shows predictable income. And almost no applicant brings it.

Self-employed (green receipts)

The challenge isn’t having an income, it’s showing that it is consistent: green receipts from recent months, bank statements showing the deposits, and the IRS tax return with the settlement note — in your case, the strongest document, because it consolidates a year of activity.

Include the proof of starting or carrying out the activity and, if you have a certified accountant, a declaration of your average monthly income: these answer the question the landlord will ask, ‘Will this continue?’

Student

Without an income of their own, the application relies on two pieces: the enrollment certificate, which proves the reason for and expected duration of the stay, and the documentation of the person guaranteeing the payment — usually the parents, acting as guarantors.

This is the situation where a guarantor is most required, and legitimately so: first read what it means to be a guarantor in a tenancy. Between the ages of 18 and 35, also check if you meet the conditions for Porta 65 Jovem — applications open for short periods of about 15 days.

Retiree

Proof of the pension amount replaces payslips, and the IRS tax return completes the picture. For many landlords, this is the most reassuring profile: stable income, with no risk of unemployment. If the pension is low compared to the rent, alternatives come into play — a guarantor, a joint application, or rent guarantee insurance.

Newly arrived foreigner in Portugal

This is the profile with the most friction and the one where preparation pays off the most. For identification, European Union citizens generally present their national ID document; third-country nationals present a passport and visa or residence permit. The NIF is essential before signing — it is obtained at a Tax Office or, when applicable, through a tax representative.

The real problem is the lack of a Portuguese track record. Substitute it with equivalent evidence: an employment contract, even international, payslips and tax returns from the home country, and bank statements with balances and regular transactions.

In practice, many landlords ask for a bank guarantee of six months to a year as an alternative to a guarantor. No law obliges you to accept foreign documents — but rejecting an application because the applicant is a foreigner is another matter, and it is prohibited.

What the landlord can (and cannot) request

The answer begins with an uncomfortable fact: there is no legal list in Portugal of the documents a landlord can require from an applicant. The tenancy law does not contain one. The limits come from outside of it — and there are three.

1. Only what is necessary: data minimization

The principle of data minimization (Article 5(1)(c) of the GDPR) requires that the data processed be adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed. In a rental application, this is whatever is needed to assess identity and solvency — and nothing more. The storage limitation principle also applies (subparagraph e): once the selection is concluded, the files of rejected applicants no longer serve a purpose and must be deleted.

As a rule, the landlord who collects the data is the data controller; the applicant retains the rights of access, rectification, erasure, objection, and data portability, with the CNPD as the supervisory authority. Health data is always excluded — pregnancy, disability, medical circumstances of the household —, which are special data categories under Article 9.

2. Non-discrimination: Article 1067-A of the Civil Code

Introduced by Law No. 13/2019, Article 1067-A prohibits discrimination in access to renting based on sex, ancestry or ethnic origin, language, territory of origin, nationality, religion, belief, political or ideological convictions, gender, sexual orientation, age, or disability. Paragraph 2 extends the prohibition to the listings themselves: no advertisement may contain restrictions, specifications, or preferences based on these categories.

The line is thin. Requiring financial capacity, or requiring a guarantor, are objective and legitimate criteria; they become illegitimate when applied only to a protected group — asking only foreigners for a guarantor, for instance.

Law No. 93/2017 treats the ‘refusal or conditioning’ of a tenancy on the grounds of racial and ethnic origin, color, nationality, ancestry, and territory of origin as discriminatory; it is overseen by the CICDR, which issues fines that, according to the specialized press, exceed 10,000 euros.

3. Copying the citizen card requires their consent

Law No. 7/2007 (Article 5, Paragraph 2) prohibits the reproduction of the citizen card without the holder’s consent, except in cases provided for by law or by decision of a judicial authority. Note the wording, which is often misquoted: photocopying the card is not illegal — doing so without consent is.

The CNPD provides three instructions to anyone receiving this request: ask what legal rule it is based on; if the copy is legally required, conceal irrelevant data; and, if it is not, ask what alternative means of identity proof is accepted.

The reason is specific: a copy of the card exposes four identifiers at once — civil identification, NIF (Tax Identification Number), SNS (National Health Service) user number, and Social Security. None of this obliges the landlord to accept the alternative, but it changes the conversation.

Security deposit, rent in advance, and guarantor: what is legal in 2026

It remains to be seen how much can be requested upfront — and this is where most misinformation circulates. In August 2026, the limits of Article 1076 of the Civil Code apply.

These caps have been in effect since January 1, 2023, introduced by the State Budget for 2023 (Law No. 24-D/2022) — not by Law 13/2019, as is sometimes stated. Previously, rent in advance could be up to three months, and the security deposit had no cap.

Adding it all up, at signing, around five rents can be requested — only the first is inevitable. And the clause requiring a security deposit above two rents is considered null and void: the contract remains, but the clause is unenforceable.

Security deposit and guarantor at the same time? It is legal: the two-rent limit applies to the security deposit, not the number of guarantees. If this is the case, pay attention to the benefit of prior excussion (Article 638 of the Civil Code): the guarantee is naturally subsidiary, the landlord should execute the tenant’s assets first.

What about the 2026 “new rental regime”? The bill approved by the Council of Ministers on July 9, 2026, provides for a security deposit without a legal limit and rent in advance of up to three months.

It is not law. Until it is approved by the Assembly of the Republic, promulgated, and published, the limits in the table above apply — the point is detailed in the analysis of the new rental regime 2026.

After signing, there is a deadline that matters to you: the landlord has 30 days to report the contract to the Tax Authority. It is this report — along with the electronic rent receipts — that makes the rent show up on your IRS tax return.

How to organize everything in a dossier

Did you notice the pattern? The same dozen files, sent dozens of times, without knowing who opened them or where they were saved. It is tedious for you and unreliable for the landlord, who receives five applications in five different formats.

In France, there is a public service for this, DossierFacile. In Portugal, there is no equivalent: the Affordable Rent Platform issues a certificate, but only within that program, not on the open market.

Frequently asked questions

What documents are mandatory to rent a property?

None, strictly speaking: the law does not establish a list of required documents for an applicant. In practice, what is needed to rent a property comes down to a valid ID, NIF (Tax Identification Number), proof of income, and proof of address. The NIF is the closest to being indispensable, as it is required for the contract.

Can the landlord require the complete IRS declaration?

They can ask for it, and it is a common request. But the GDPR mandates that the processed data be only what is necessary to assess identity and solvency, which leaves room for negotiation: ask what the purpose is and propose submitting only the relevant pages, or a version with the non-pertinent elements hidden.

Can I refuse to provide a photocopy of my citizen card?

You can. The reproduction of the citizen card depends on the consent of the holder (Law No. 7/2007, Article 5, Paragraph 2), unless there is an express legal provision or judicial decision. The CNPD advises asking on what regulation the request is based and requesting alternative means of proving identity. Be realistic: nothing obliges the landlord to accept that alternative.

How many months of rent can be requested upfront?

With the law coming into effect in August 2026: the first month’s rent, up to two months in advance (with a written agreement), and a security deposit of up to the value of two months’ rent — about five in total.

Neither advance rent nor a security deposit is mandatory, and a clause demanding a security deposit greater than two months’ rent is considered void. The ‘free security deposit’ is part of the 2026 proposal, which is not yet law.

What if I just arrived in Portugal?

Get your NIF first, which you must have before signing, and gather your passport with a visa or residence permit (or your national ID document, if an EU citizen). Without a Portuguese history, substitute it with an employment contract, payslips and tax returns from your country of origin, and bank statements. Rejecting an application based on nationality is prohibited discrimination.

Can the landlord ask for a criminal record?

Data relating to criminal convictions are subject to the restrictive regime of Article 10 of the GDPR and, in current interpretation, requiring them in a residential lease is disproportionate and lacks legal basis. If you receive such a request, ask what the purpose is and on what legal rule it is based.
