Download it free in PDF and Word.
- Identification of the parties, the guarantor and the lease amended
- Matters to tick: rent, term, tenants, occupants, pets, other clause
- Clause keeping the rest of the lease in force, and effective date
- Reminder to notify the Tax Authority (Stamp Duty Form 2, art. 60 CIS)
- Signatures of Landlord, Tenants, new tenant and Guarantor
When to make a lease addendum
Whenever the parties agree to change something in the lease in force: rent, term, a tenant joining or leaving, permission for pets. The annual update by the statutory coefficient needs no addendum.
Addendum and reporting to the Tax Authority
Changes to the lease are reported to the AT on the Stamp Duty Form 2 (article 60 of the Stamp Duty Code), as a rule by the end of the following month. Check the procedure on the Portal das Finanças.
How to fill it in
- Identify the parties and the lease.
- Tick the matters being changed.
- Fill in only the ticked clauses.
- State the effective date.
- Everyone signs, including the guarantor.
Mistakes to avoid
- Changing the rent by message only.
- Forgetting to report to the AT.
- Setting a term under one year for a permanent home (article 1095(2)).
Frequently asked questions
What is the difference between an addendum and an amendment to the lease?
In practice, none: both refer to the document that changes a lease in force. The lease stays as it is in everything the addendum does not change.
Must the addendum be reported to the Tax Authority?
Changes to the lease, such as a rent increase, are reported to the AT on Stamp Duty Form 2 (article 60 of the Stamp Duty Code). As a rule, the deadline is the end of the month following the change; check on the Portal das Finanças.
Can I increase the rent with an addendum?
Yes, by agreement between the parties. The annual update by the statutory coefficient is different: it is done by letter to the tenant, with no addendum.
Do I need an addendum to add a person to the lease?
To make them a tenant, yes. Members of the tenant's household and up to three lodgers may live at the property without an addendum, unless the lease says otherwise (article 1093 of the Civil Code).
