The Entry Inspection In the lease is the registration, division by division, of the state of the property at the moment when it is delivered to the lessee — the only evidence capable of sustaining, months or years later, a retention of a security deposit for damages on departure. What is the entry inspection and when to do it

The entry inspection records the state of the property at the entrance of the tenant — walls, floor, equipment, counters — the moment the keys are handed to him. It must be done on the very day of delivery, with the two parties present whenever possible, and signed by both before the lessee moves. It is the starting point of any housing lease and the reference used, at the end of the contract, to compare with the exit inspection.

What does this inspection model include?

  • identification of the property, the contract and the parties present

Each division has its own line, so that the state registered at the entrance serves as a direct comparison, item by item, with the exit inspection at the end of the contract.

How to fill out the property status checklist step by step

  1. Fill in the identification of the property, the reference of the contract and the date of the inspection.
  2. Scroll through the division to the division, assigning a state — new, good, reasonable, used or damaged — to each one and noting specific observations.
  3. Record readings of electricity, gas and water meters.
  4. Count and write down the keys, badges and commands delivered.
  5. Take support photographs for each division and tick the corresponding box.
  6. Review the general observations and sign both parties, with date and place.

Legal basis and deadlines for the entry inspection

Portuguese law does not formally oblige the carrying out of an inspection. What the law says is something else, and that is why the inspection matters: Article 1043, paragraph 2 of the Civil Code presumes that the thing was delivered to the lessee In good condition of maintenance when there is no document in which the parties have described their status at the time of delivery. This presumption protects the landlord from the starting point, but does not replace the proof of concrete damage at the exit — and that is where the entry inspection, with photographs and dated signatures, makes the difference. Without it, a security deposit becomes much more difficult to support before a tenant than contests it.

It should be noted that the security deposit has a legal ceiling: Article 1076, paragraph 2 of the Civil Code allows to guarantee the fulfillment of the obligations up to the amount corresponding to two laces. It is yet another reason to document the initial state well — the margin to cover damage is limited and does not expand by charging more money at the entrance.

When retaining security deposit amounts at the end of the contract, always discriminate the amounts per division and gather budgets or repair invoices: there is no rule that allows a generic retention, and is the entry inspection — detailed and comparable with the output — that provides support to this discrimination.

Mistakes to avoid in the entry inspection

  • Do not carry out an entry inspection — only the exit — leaves the landlord without a comparison to prove damage.
  • Vague descriptions as good general condition, without detailing each division, which do not resist a contestation.
  • Do not take dated photographs to support written observations.
  • Forget the readings of the counters, essential to correctly distribute consumptions between tenants.
  • Only one of the parties sign, or sign, without the effective presence of the lessee.
  • Do not deliver a signed copy to the lessee — both parties must keep the same document.

FAQ

Is the entry inspection mandatory by law?

There is no rule that formally obliges the entry inspection, but is the practical way of documenting the state of the property and of being able to prove damages to the exit inspection, supporting a possible retention of the security deposit.

Who should be present at the entry inspection?

Ideally the landlord (or a representative) and the lessee, so that both sign the same document on the same day. If one of the parties cannot be present, the inspection must be carried out with witnesses and the notice sent to the absent party.

What difference does the entry inspection make to the deposit return?

Without an entry inspection, the landlord has to prove himself that a damage found at the exit did not exist before — which in practice is very difficult without photographs and a registration signed on the date of delivery. With the inspection, the comparison between input and output makes the retention of bond values much more defensible.
