Are you living in a rented home on a “handshake” basis, with no written contract, or with a contract that never went to Finanças (the Tax Authority), and has someone told you that you “have no rights at all”? That is false. But you are not protected as you should be either.
This guide separates the three situations that everyone mixes up (a verbal contract, an unregistered written contract and a registered contract) and shows how to regularise yours, step by step.
The essentials in 30 seconds
- The law requires a written contract (art. 1069 of the Código Civil, the Civil Code), but if the lack of one is the landlord's fault, you can prove the tenancy by any means (bank transfers, witnesses, utility bills).
- A written contract that is not registered with Finanças is valid between the parties: registration is a tax obligation of the landlord, not a condition of validity.
- But without registration you are blocked in practice: no receipts, no rent support, no income tax deduction, no proof of address.
- Since 2025, the tenant can register the contract directly on the Finanças Portal.
The three situations, and what each is worth
| Situation | Is it valid? | Practical consequences |
|---|---|---|
| Verbal contract (“on a handshake”) | The law requires a written form, but a failure attributable to the landlord does not leave you unprotected (art. 1069(2) CC) | You can prove the tenancy with bank transfers, messages, utility bills in your name and witnesses; a fragile position in a dispute, so demand a written contract |
| Written contract, not registered with the AT | Valid between the parties | The landlord is in tax default; you are left without receipts, support schemes, income tax deduction and proof of address until it is registered |
| Written and registered contract | Valid and complete | Monthly electronic receipts, access to support schemes, income tax, address: the situation you should be in |
What you lose while the contract is not registered
- Electronic rent receipts, the official proof that you pay (how they work);
- Rent support: the extraordinary support and Porta 65 require a registered contract (guide to support schemes);
- Deduction of rent from income tax (IRS): without registration and receipts, there is no deduction;
- Proof of address: a registered contract unlocks it (the 7 ways);
- Legal certainty: deadlines, updates and protection in an eviction become much harder to enforce.
How to regularise: 3 steps
- Ask for the written contract (or the registration) in writing: an email or simple letter: "I ask that we put the contract in writing and that it be reported to Finanças, as the law provides." Most landlords regularise things once they realise the request is on record;
- If nothing happens, use self-registration: since 2025, the tenant can report the contract directly on the Finanças Portal, precisely so as not to be held hostage by the landlord's inaction. You need the details of the property and the landlord, and proof of payment;
- Check what you sign: if the landlord finally produces a contract, check the clauses for free before signing: a deposit above 2 months' rent and waivers of your rights are void.
Frequently asked questions
Is a verbal lease agreement valid?
The law requires a written form (art. 1069 CC). But if the lack of a written contract is due to the landlord, the tenant is not left unprotected: they can prove the tenancy by any means, by showing use of the home and monthly payment of the rent.
Is a contract not registered with Finanças valid?
Yes, between the parties: registration is a tax obligation of the landlord, not a condition of the contract's validity. But without registration you are left without receipts, support schemes, income tax deduction and proof of address.
How do I prove I live in the home if I have no contract?
Bank transfers with the description "rent", messages with the landlord, bills or correspondence in your name at the address, and witnesses. Start today by always paying by bank transfer.
Can I register the contract without the landlord's cooperation?
Yes. Since 2025 the tenant can self-register on the Finanças Portal. The landlord keeps their tax obligations; you unlock support schemes, income tax and proof of address.
Does paying in cash hurt me?
A lot: with no payment trail, your evidence is weakened. Switch to paying by bank transfer with a clear description and ask for a receipt for each rent payment, which is your right.
